A Bad Night for E-Cigarettes, Bond Debt Resolutions, and Brevity: Duluth City Council Notes, 9/9/13

First off, it’s primary election day…if you’re a Duluth resident and you haven’t voted yet, you have until 8:00. Get out and vote! I’ll have some comments on the results either later tonight or tomorrow afternoon.

A substantial crowd was on hand on a rather disgusting, drizzly Duluth night on Monday, and the Council tried to put its best side forward, with all its gentlemen donning more formal wear than usual (save Councilor Fosle, who wore his regular black polo shirt uniform). Many of the issues introduced or unresolved at the last meeting were back on the agenda, leading to a very long night (and, thus, a very long blog post summary). Councilor Krause opened the meeting by announcing he would not retire until after the next meeting, a change that caused a lot of confusion later on as the Council tried to figure out a timeline to appoint a replacement.

After hearing from a speaker on the proposed Canal Park revitalization who also had some issues with street lights, the Council cleaned up the confusing road salt issue from the previous meeting, with Ms. Linda Ross Sellner again scrutinizing the funding practices and noting environmental damages caused by salt. Councilor Fosle concurred with her worries and hoped that more sand would be used in the future, and with her concern noted, the resolution passed, 9-0, as did the consent agenda.

President Boyle then moved the issue with the largest public interest to the top of the agenda, and no fewer than thirteen speakers came forward to address three ordinances that amended the City Code to regulate the sale and use of electronic cigarettes. Most of the speakers were in support of the regulations, and the anti-smoking crowd was well-organized and had solid public speakers. Several doctors, healthcare professionals, and members of the American Cancer Society came forward to decry e-cigarettes, expressing their worries about health, secondhand smoke, normalization of smoking around children, and the utility of e-cigs as a smoking cessation device. Three speakers countered them, however; one ranted about bad government regulating things excessively, one asked the Council to put things off until further evidence emerged, and Mr. Brian Annis—a leading advocate who aims to open an e-cig business—returned to cite several studies countering those mentioned by the opposition.

The first of the three amendments would also prove the most contentious, as it sought to eliminate a loophole in the Minnesota Clean Air Act that allows sampling of products in businesses. (The measure would also ban such establishments as hookah bars.) Councilor Krause, in search of a compromise, suggested an amendment with a very strict standard: only businesses with more than 80% of their sales on these products—basically, smoke shops—could allow sampling. This, he argued, would allow people to test the product before purchase, keep businesses in the city, and would not adversely affect children, as they are not allowed in such shops anyway.

However, it quickly became clear Councilor Krause’s amendment would face an uphill battle, as one of his potential supporters, Councilor Fosle, announced his refusal to endorse any attempt to regulate e-cigs at all. He accused the Council of a lack of faith in the state government (which is not as stringent in its restrictions) and made expert use of a red herring by saying the council should be more worried about children trying heroin and ecstasy instead of cigarettes. Councilor Gardner, on the other hand, did break away from the Council’s more liberal voting bloc and announced her support for the Krause amendment. Councilors Krug, Julsrud, and Larson said they would rather hold the line on the Clean Air Act, while President Boyle said he couldn’t support anything that marketed itself in a “cherry bubble gum cotton candy” flavor. The Krause amendment failed, 6-3, with Councilors Krause, Gardner, and Stauber in support of it.

With his amendment gone, Councilor Krause explained why he couldn’t support the ban on sampling. He emphasized property rights, saying private businesses should be able to ban e-cigs as they choose, but nothing more. He also made the point—on which all parties agreed—that existing research was inconclusive on the health effects, and that in the meantime, it made little sense to regulate something that might help people quit. Councilor Gardner agreed, and both pointed out the countless carcinogens and toxic substances we ingest in small quantities every day. Councilor Gardner (a former smoker herself) added that adults are allowed to enjoy silly flavors as well, and that they can make smokers feel less dirty about smoking as they try to quit. Councilors Larson and Julsrud shared a rather different theory of government, and insisted that the Council had an obligation to learn from past manipulations of marketers of tobacco-like products, and that e-cigs should be banned until proven healthy. The Council voted to close the sampling loophole, 6-3, with Councilors Fosle, Gardner, and Krause in opposition. Mr. Annis left the Chamber in defeat, and a loud noise could be heard from the hallway.

It was at this time that Councilor Gardner took the floor to deliver the most compelling speech I’ve seen since I began attending Council meetings. She conceded defeat, admitting that all of the e-cig restrictions “will pass, and you’ll all be happy,” but took issue with the tactics used by the anti-smoking lobby. The reliance on shame as a bludgeon, she insisted, did more harm than good to everyone involved. She noted that many smokers are poor and low-income people (often without health insurance) who are “humiliated” by anti-smoking campaigns, and claimed these are “polarizing” and “not a good way to change behavior.” She recalled her own adolescent self, and how she’d been attracted to things that were so stigmatized by the supposed do-gooders in the establishment, and wondered what would happen if the anti-smoking groups dropped their expensive shaming campaigns and instead focused their message on cessation devices. “Top-down changing ordinances are not the answer,” she said, saying they were reminiscent of the failed temperance movement. “If we’re a compassionate community, we need to think about this,” she concluded, adding that she felt better now that she’d finished her lecture. Her speech visibly affected several members of the Council and the audience, and one can only hope her words will not be forgotten.

Debate then went forward on the ban on e-cigs in public places, and Councilor Hartman was careful to note that this is not a ban on the product altogether, but merely an effort to regulate them like cigarettes, lest they become a “gateway;” Councilor Krug made similar point about the “slippery slope” of making exceptions to smoking restrictions. Councilor Krause called the measure ineffective, calling it a “band-aid” that could never rectify the “group, family, and cultural dynamics” that push people to take up smoking. Councilor Gardner largely agreed, but figured something was better than nothing, and voted for this measure; it passed, 7-2, with Councilors Krause and Fosle in opposition. The final resolution, a measure that treated the sale of e-cigs like regular cigarettes, passed 8-1, with Councilor Fosle being the lonely “no” vote. Councilor Stauber thanked Councilor Gardner for her comments and admitted that this was a “government intrusion,” and while he does not normally support them, he thought that this one was the right thing to do.

After nearly two hours on e-cigarettes, the Council then settled its tax measures for the coming year in the matter of minutes. The right-leaning bloc of Councilors Krause, Fosle, and Stauber raised a few objections, but Councilor Hartman was quick to point out the slight tax decrease, and most of the measures passed along the predictable 6-3 line. (Councilor Fosle also opposed park and bus funding measures that passed 8-1).

Next, the Council revisited the debate over servicing bond debt on street improvement (see last meeting’s notes for details).  Councilor Hartman had fine-tuned the language of the previous measure, this time making it clear that any funds from the casino settlement would be used to replenish the Community Investment Trust (CIT) fund, but the three conservatives once again refused to draw down the CIT any further. This time around Councilor Krause had his own counter-proposal, though his attempt at a compromise on the issue found even less traction than his stance on e-cigarette sampling, as it failed to attract any liberal votes or impress his two conservative colleagues. Sensing an impasse, Councilor Gardner tried to table the measures, but was voted down 5-4; forced to take a side, she continued her tour de force, demanding to know from CAO Montgomery just how much street repair interest on the CIT could fund. The answer was “less than a mile,” and Councilor Gardner rested her case, saying a gamble on the city’s credit rating was not worth less than a mile of road.

Councilor Julsrud was even more direct in her attacks on those defending the CIT, and lashed out at Councilor Krause for “playing politics” with the issue, a reference to things that must have been going on behind closed doors. Councilor Krause defended himself, again complained about the “betrayal” of the Administration that had said it would hold the line, and said he didn’t know how much CIT money the Council might need for streets in the future. Councilor Fosle griped that CAO Montgomery had claimed to be “open to proposals” but had shot them all down, and repeated his line of the night, which accused the city of excessive spending on “fancy, frilly stuff.” Twice during the meeting, Councilor Hartman effectively called his bluff: while Councilor Fosle claims to have a host of money-saving measures in mind to cut out the fancy frills, why haven’t they come before the Council? Still, both measures failed, leaving the debt service issue unresolved.

After the tedious debate over how to go about replacing Councilor Krause (in which Councilor Gardner again had an excellent line by agreeing that Krause’s replacement “shouldn’t be a flaming liberal like myself,” and instead agree with Krause on most issues, and Councilor Stauber did a lot of worrying over subverting the interests of the voters of District Four), Councilor Stauber tried to get the Council to veto an increase in natural gas rates. In a lengthy discourse, he complained that an outside firm had called for a lower rate than the Public Utilities Commission had supported, and that a newfound utilities surplus made the rate increase pointless. Councilor Julsrud commended Councilor Stauber for being “masterful at spinning things,” while Councilor Gardner called him “penny-wise and pound-foolish,” saying the increase amounted to roughly $1.05. Councilor Fosle had his usual complaints, Councilor Hartman had a rejoinder, and Councilor Julsrud said the rate increase would help build a reserve that would help to deal with “ever-changing capital needs.” Councilor Krug said the Council should listen to its commissions unless there is an “egregious” error in their work, while Councilor Krause countered that these taxing authorities often operate in vacuums and didn’t have a good sense of the big picture of city tax rates. The veto attempt failed, 6-3, with Councilors Stauber, Krause, and Fosle in support.

Exhausted, the Council did its best to hurry through most of its remaining business, though Councilor Fosle held up a few issues for comment, and was the lone ‘no’ vote against some legal fees (which Councilor Stauber said had been a “bad decision” but supported anyway). The longest debate was over a reconstruction design for Superior Street; Councilors Fosle and Krause worried about the lack of a funding mechanism, but Councilor Stauber said he was satisfied that the money was there, and Councilor Gardner expressed incredulity that anyone would hold up this project. The measure passed, 7-2. The rest of the agenda passed unanimously, Councilor Larson wished CAO Montgomery a happy birthday, and the Councilors and the four remaining audience members (including myself and two current Council candidates) were relieved to finally exit the chamber, three hours and fifty minutes after the start of the meeting.

Duluth City Council Elections 2013: A Patient Primary Primer

This is what your ballot will look like. 

The Duluth City Council is in a different universe from the School Board. There are no hugely contentious issues before it, and the current edition appears to have a pretty good rapport. There is no rush to throw the bums out here, though we do have two open at-large seats, following the retirements of Councilors Jim Stauber and Dan Hartman. The entire primary will only eliminate one candidate.

At-Large

Five people are competing for four spots in the general election. Once again, I list candidates in my rough order of preference.

Zack Filipovich, a recent University of Minnesota-Duluth graduate, appears to have one of the better-organized campaigns out there. He’s been endorsed by the DFL, but his campaign also focuses on his experience in finance and economic development, which leads one to hope he’ll mind the checkbook better than some other well-intentioned but not-overly-financially-savvy left-leaning Duluthians. Councilor Hartman’s retirement also leaves the Council with a relative lack of young people, and Filipovich fills that niche. That’s an important thing to have, especially in a city that makes a big deal out of attracting and retaining young people. His platform (website here) could use more specifics, but in a field where no one really blows me away, he’s at the top of the ballot for now.

Barb Russ is probably the most experienced candidate in the field, and probably has the strongest campaign going, with a concise but clear agenda and lawn signs everywhere. Just as Rosie Loeffler-Kemp’s résumé just about screams “school board member,” Russ’s bellows “city councilor.” She is a very safe and predictable choice, and while she may not be wildly inspirational, she should be an effective Councilor. Ryan Stauber is the son of outgoing Councilor Jim Stauber, and his emphasis on “balance” suggests his views are fairly similar to his father’s. Like Filipovich, he’s young, and has likewise demonstrated a clear commitment to his city. Given the need for some balance and debate, I was very tempted to put Stauber in one of the top two slots. With the retirement of his father and Councilor Krause, two of the three more-or-less fiscally “conservative” voices on the Council will be gone, and I worry that simply supporting the two DFL-endorsed candidates may contribute to City Council groupthink. Victories by Filipovich and Russ would effectively marginalize the opposition on the Council, and leave it in the sole hands of Councilor Jay Fosle—and, given Councilor Fosle’s tendency to be a bit haphazard in his criticisms, I’m not sure that role suits him. Duluth’s recent experience with a lonely voice standing up to the rest of a board (coughArtJohnstoncough) has not been pretty.

Still, I need more than “balance” as a reason to support someone, and Stauber hasn’t quite inspired me. His main point of emphasis, city infrastructure, is also Russ’s, and other than a vague mention of stronger law enforcement (which is part of his background), there isn’t much here. If he goes through to the general election, I’ll certainly give him a second look. Unsolicited web site advice: putting childhood awards and volunteer experiences (ie. some governor’s award won in middle school, marathon volunteering) on your résumé just makes it look like you’re padding it. There is potential here, but the product isn’t quite polished enough yet.

A fourth candidate, Ray “Skip” Sandman, emphasizes his Anishinaabe (Ojibwe) roots on his website, and aims to bring diversity to the Council. Considering the recent controversy over an eagle staff and lack of racial minorities on the Council, this is all well and good; the problem is, I don’t see a whole lot of meat on the bones here. Other than a vague mention of living wage jobs, he doesn’t say what else he’ll do. Tell us more, Ray! Website here

The final candidate is Ray Whitledge, whose use of the Statue of Liberty on his campaign signs underlines his staunch libertarian views. His Facebook page (I couldn’t find a website) straight-up says he thinks taxation is robbery. To his credit, he sounds like he really practices what he preaches, and will only accept tiny amounts of voluntarily-donated pay if he serves on the Council. However, 99% of his proposals probably won’t fly, leaving him in that dreaded “lonely voice” category I worried about in my comment on Councilor Fosle above. His emphasis on ideology over community leads me to doubt he’ll be able to work with his fellow Councilors in a constructive way. I’m somewhat intrigued to see what a town governed by libertarians would look like, but I don’t want Duluth to be the guinea pig—nor is it realistic to expect that here, given Duluth’s deep left-leaning roots. This city is what it is, and the best of the candidates here accept that, even if they disagree on everything else.

District 2

Councilor Patrick Boyle is running unopposed, so there’s no intrigue here…yet, at least. Boyle has thrown his name in for the special election to replace late County Commissioner Steve O’Neil, and should he win that race in February, he will need a replacement. Stay tuned.

District 4

With Garry Krause’s surprise retirement this week, Howie Hanson is now running unopposed in this race. I had plenty to say about Mr. Hanson on Friday. Even for people somewhat more sympathetic to Mr. Hanson than I am, it is unfortunate he will not face a challenger who might at least force him to come up with some sort of platform. Instead, he will likely coast into the Council with his false charm and vague interest in the community on full blast. District 4 residents, if you have any ambition to enter local politics, now would be a great time for a write-in campaign.

The lack of competition in Districts 2 and 4 is, frankly, a bit disappointing. I suppose it might be a sign that people are fairly happy with the work the Council is doing—an understandable stance, given its relative efficiency and lack of drama of late—but a little debate here wouldn’t have hurt. It is what it is, though, and there are some diverse voices in the at-large race. Unfortunately, in my estimation, the candidates who venture away from the establishment are also the weaker candidates. I think there’s a lot to say about that, but I’ll hold off until after the primary, when we’ll have a better pulse on what the voters of Duluth are thinking.

Now, some comments on the race and the candidates.

As anyone who follows Duluth politics knows, the School Board is riven by lingering controversy over its expensive Long Range Facilities Plan (the Red Plan), which got the city a bunch of shiny new schools and a bunch of very angry taxpayers who have voted against anything school-related ever since. Opponents of the Red Plan didn’t make much headway in School Board elections, however, leaving Member Art Johnston the sole critic on the current Board. As a result, he has waged a scorched-earth campaign over the past four years, doing everything he can to disrupt the final stages of the Red Plan (which was implemented nearly in full before his tenure began).

It is frustrating to watch Member Johnston’s antics, and I say this as someone who does not want to see the School Board be a rubber stamp machine. I want to see critics; people who will make very careful decisions with the paltry pot of money the Board has to work with, look for creative new solutions, and who will question the tendency of the Superintendent and the Board’s majority to move in lockstep. The problem is that most of the existing critics are so eccentric or embittered by the Red Plan rancor that they are hopelessly disruptive, and show few signs of being able to work with the rest of the Board. That makes for good theater, but it does not make for good governance.

Thankfully, after this election cycle, the Board could very easily have only one person left over from the whole Red Plan debate (Member Seliga-Punyko, who beat Loren Martell last election cycle). Everyone else who implemented it could be gone, as could the “interesting” cast of opponents…if Duluth can come through and vote against them all. This is the easiest path to long-term health for ISD 709. Love or hate the Red Plan, it happened, and Duluth has to decide what comes next, not repeat old debates.

At-Large

Current Members Mary Cameron and Tom Kasper have chosen not to seek re-election, freeing up two seats here. There are six candidates, two of whom will be weeded out in the primary. I list them here in a rough order of preference.

In the search for a new Board member who will question the status quo, Joshua Bixby may be the best bet. His campaign website is easily the most extensive out there, and includes Mr. Bixby trailing on about issues large and small. When addressing the Board as a citizen, he came across as articulate, insightful, and responsive to public opinion. He is a recent arrival to Duluth, meaning he wasn’t even here when the Red Plan debates started, and wants to move past that while also wrestling with the financial issues created by the Plan. I’m not sure I agree with him on everything, but I think his voice is a necessary one, and could be a very constructive addition to a Board that has been anything but constructive lately.

Annie Harala is another youngish newcomer to ISD 709 politics. Her campaign website isn’t all that detailed, though at least she has one, and it does get points for prettiness. I applaud her support of “community schools”—that is, schools that emphasize a holistic education and unite the school with the surrounding neighborhoods through a number of initiatives. She looks to be a safe choice.

Henry Banks, a man best known for his radio show “People of Color with Henry Banks,” has been involved in a number of community organizations over the years, though none of them focus explicitly on education. An African-American, Banks is certainly in tune with Duluth’s serious achievement gap issues, and with Member Cameron’s impending retirement, he is the only potential minority School Board member. Beyond that, though, he’s hard to pin down; he doesn’t have a website yet (Facebook page here), and there isn’t much substance detailed there.

Even though he is not a new figure, I actually have a decent amount of respect for Harry Welty. I think he tries to assess things fairly, even if he is sometimes wrong in said assessment; he is well-informed and, tendency for hyperbole aside, seems to be a genuine person who is capable of working well with others. Sure, he has a huge ego and a talent for grandstanding, but he can also appreciate nuance and can be self-deprecating at times, too. (His long-running website will tell you more than you ever wanted to know about his life and his stances on ISD 709 issues.) I’m not voting for him in the primary, but if you think a member of the old Let Duluth Vote crowd deserves a voice on the Board, though, Harry has the strongest credentials.

Nancy Nilsen, a Board member from 2006-2010 who helped push through the Red Plan, is one I’d throw out as old news. I really don’t care whether or not she was right, or how well-prepared she is due to her work on other matters. She was a part of that whole mess, and the District needs to move on.

Loren Martell is a regular member of the anti-Red Plan crowd. To his credit, he’s done his homework on district finances, and he’s managed to get an audit of the District; I’m curious to see the results. However, even if the audit vindicates his stance, that does not suddenly qualify him to make decisions over the futures of Duluth students. His speeches in front of the Board can be painful to listen to, and that has nothing to do with their content: he rambles, casts about charges, and generally fails to sound coherent. (At the first few meetings I attended, I chose not to mention his appearances before the Board in my write-ups because I honestly thought he was somewhat “slow,” and that picking on him would be in poor taste.) At any rate, he gives little indication that he knows anything about what a school board does beyond his stance on a facilities plan that has already happened. He sounds like Art Johnston 2.0, only without Art’s penchant for good quotes. Maybe he’s been goaded into anger and incoherence due to his frustrations with the Board; not having followed Board affairs closely during my four years out of Duluth (2008-2012), I don’t know. But that frustration is the exact reason I can’t endorse him: everyone touched by that bitter debate is tainted. It’s time to move on.

District 1

Rosie Loeffler-Kemp has, quite simply, devoted her life to education. She has served in just about every PTA or parent-advisory position imaginable, and as she lives in the neighborhood, I remember seeing her at just about every school function while growing up. As with all the candidates here, her platform is a bit vague, but she is a relentlessly positive person, and no one will doubt her work ethic. Judging by an informal lawn sign count, she’s the favorite here, and since I’ve supported a couple of younger, newish people in the at-large races, I’ll use my vote in my own district for someone who has a little more experience. One word of advice on the lawn signs, though: “informed” and “involved” are acceptable ways to describe a candidate, and in her case, very true. Describing oneself as “interested,” however, seems laughably self-evident. Is anyone running for the School Board really not “interested” in the position? (Facebook page here)

This district has two pretty strong candidates, though, and Joe Matthes is the other. He is a newcomer to Duluth politics, a 20-something with a couple of young kids. He is a union rep who has experience on the labor side of things, and to date he is the only candidate to leaflet my house (he lives down the block, though I don’t know him personally), and his literature hits all the right notes. (Facebook page here) I would have no qualms voting for him; it’s unfortunate he is in the same race as Loeffler-Kemp.

Marcia Stromgren is a member of the anti-Red Plan crew, and not even a terribly interesting one at that. She is good at complaining about things but offers little of substance, has no web presence, and her campaign signs appear to put emphasis on the “tax payer.” (Hopefully her efforts to save taxpayers money will not lead her to target English classes that might teach Duluth students that “taxpayer” is, in fact, one word.) On the flip side, her intriguing headgear would brighten up the Board meetings.

District 4

This is perhaps the juiciest race of the election cycle. As in District 1, it’s a three-way race pitting an anti-Red Plan name against two opponents, one a longtime schools activist, one a young newcomer.

It’s hard to see many huge distinctions between the two challengers here. Justin Perpich is a recent Duluth arrival with a young child, while David Bolgrien is a longtime volunteer and PTA member. Both have a pretty similar emphasis in their campaigns, as they try to bring positive messaging back to District Four. Bolgrien appears a bit more antagonistic toward the incumbent, and he also endorsed Nancy Nilsen on his Facebook page (ostensibly because she is also a west-sider, though that gives some idea of his loyalties in the Red Plan debate). Because of that, I’d tip my support toward Perpich, who also has a website here that puts a little more substance behind his campaign. Still, I’d support either one against the incumbent.

These two men are, of course, taking on Art Johnston. Here is his website, “Truth in Duluth.”

I’ve probably made my opinion on Member Johnston abundantly clear in my posts on School Board meetings. My critique effectively boils down to the same one I made of Mr. Martell: just because he has a different opinion does not mean he is well-qualified to represent that opinion. His eternal disruption has yet to achieve anything of substance, and only reinforced the bunker mentality among the rest of the Board. It is time to move on.

I’ve said it many times, and I’ll say it again: it’s time to move on. On Tuesday, we’ll learn just how much Duluth agrees with that sentiment.

Exit Garry Krause; Enter Howie Hanson

Forgive me, followers from afar:  with primary elections this Tuesday, this blog is going to be pretty much nonstop local politics for the next few days. But if you like reading about nutty local wannabe-politicians, this post should amuse you anyway. I’d intended to start this series tomorrow, but a surprise announcement has me rushing to get this post up early.

Garry Krause, a member of the Duluth City Council, has announced that a new job will leave him unable to continue on in his position. He will attend his final Council meeting this coming Monday. The city will have to decide whether it will fill Krause’s Fourth District seat until next January, when the winner of this fall’s race for his seat–which is now a one-man race–will take office.

I didn’t always agree with Councilor Krause, but when it came to professionalism on the City Council, he was second to none. As I wrote a couple of months ago, he manages to blend principled stands with decency and civility. He was a dedicated public servant, and brought a necessary voice of skepticism to the Council without ever being overbearing or self-righteous in his critiques. I would have gladly endorsed him for a second term, and the city will miss him. I wish him well in his new position, and I definitely respect his decision to prioritize his family over his political career.

That said, I can’t pretend I’m not somewhat bitter over his departure from the race at this point, which leaves local blogger Howie Hanson unopposed in his pursuit of the Fourth District seat.

For the most part, Howie’s blog just plugs community events, and I appreciate people who put in that sort of community service. However, facile mentions of local events do not qualify one to wrangle with esoteric ordinances and resolutions. He doesn’t have a campaign website yet (and probably won’t need one, now that he has no opponent), so it’s hard to evaluate what other qualifications he may have other than being interested in things.

Admittedly, I also have a bit of a history with Howie: he tried to be a high school hockey analyst for a little while, and quickly made himself the laughingstock of the local hockey community. That may seem petty and irrelevant to his potential work on the City Council, but the character he displayed was not what I want out of a Councilor: he pretended to be objective when he had obvious loyalties, he took it upon himself to call out the “arrogance” of certain teams without any evidence, hyped up some players to absurd levels, and when people called him out or noted his numerous errors, he quickly deleted things and pretended he’d never written them. He was sloppy, held grudges, and did not take criticism well at all. I’ve disagreed with any number of hockey commentators on any number of issues over the years, but with the vast majority of them, I’m able to get over that and have a friendly relationship; Howie, on the other hand, was quite incapable of participating in a dialogue like that. That doesn’t inspire much trust.

Howie, who can be found wandering the Heritage Center wearing swag that advertises his blog, also once got the School District to pay him $19,000 a few years back so that he could do things that anyone with a basic knowledge of computers could do–allegedly for 30 hours a week! (Why not have kids do it?) Needless to say, his “goduluthschools.com” website was a total flop, and typing that address into your browser now gets you a thrilling series of posts on HGH and penis enlargement. I don’t think he’s a bad or dangerous person; I will just be surprised if he proves a competent city councilor.

I suppose there’s some chance that someone will mount a write-in campaign now that Councilor Krause is out of the picture, but even if that happens, we’re likely stuck with Howie. It’ll be an “interesting” four years on the Duluth City Council.

Hooray for Being Boring: Duluth City Council Notes, 8/26/13

It was an oppressively hot and humid Monday night in Duluth, with several of the audience members huddled up against the windows in search of cold air, and an impressive lightning show flickering away over the darkened harbor. But neither heat nor storms could deter the Duluth City Council from tireless debate over servicing street debt, and after draping themselves over the drinking fountain to prepare themselves, President Boyle brought down his gavel and sent the Councilors off on their marathon.

As usual, community speakers led off the meeting, and there were only two signed up, though one brought his “little elves” with him. Mr. Jeff Mass of the Duluth Children’s Museum was joined at the podium by middle-schoolers Garrett and Jenna, who told the Council about their studies of outer space, which will culminate in a ten-minute radio chat with the astronauts in the International Space Station next week. (Exact time and date TBD; their pretty flyer tells us to check the Children’s Museum website for updates.) The only other speaker, Linda Ross Sellner, wanted a clarification on some road salt purchases, which led the Council to pull the resolution from the consent agenda so that an apparent typo in the agenda could be corrected.

After that it was on to the main event of the evening, the discussion of a resolution that would service $2.23 million in street improvement bond debt via money from the Community Investment Trust (CIT). As CAO Montgomery and Councilor Gardner explained, the city had 3 options to service the debt:

1. Take the money from the general reserve fund, which might jeopardize the city’s credit rating;

2. Raise the tax levy, effectively doubling street-assessed taxes in the city;

3. Take the money from the CIT, which would prevent a tax increase and be less of a threat to the credit rating.

CAO Montgomery thus suggested that Option 3, while not ideal, was the best choice on the table; Councilors Gardner, Julsrud, Hartman, Larson, and Krug all voiced their agreement in similar terms. Taking money from the CIT, however, requires a 7-2 supermajority, and with Councilors Fosle and Stauber raising serious doubts, it became clear that Councilor Krause would be the deciding vote.

Councilor Krause admitted to being “torn” on the issue. His reservations, which were repeated by Councilors Fosle and Stauber, revolved around the city’s frequent forays into the CIT despite claims that it wouldn’t take any more money from it. He was “surprised” and “frustrated” that this had come before the Council just a year after being told the city would find a long-term fix. CAO Montgomery countered that the city’s new, pay-as-you-go street funding plan would, eventually, take this issue off the table. Councilor Stauber replied by saying that the city is still has serious unfunded debts (mostly in pensions) and is also spending money on things such as trails; even if they aren’t accruing more street debts, their approach is not totally “pay-as-you-go,” and debt will continue to be an issue.

Councilor Krug said that all of the “woulda, shoulda, coulda” out of the Councilors griping about past funding issues was “useless,” while Councilor Larson asked what realistic alternative they might propose. Councilor Fosle, more on-target than last meeting in his critiques, went back to his favorite hobbyhorse and proposed savings in vehicle maintenance; Councilor Stauber said he’d proposed a street bill that had been shunted aside, but CAO Montgomery argued parts of his proposal “would not apply.” He also disagreed with Councilor Stauber’s suggestion that the general fund had been built up by taking money from the CIT; while technically true, the funds had arrived there in a round-about way. Councilor Fosle wrapped up the hour-long discussion by saying he thought the mayor’s office, and not the Council, should be working on the street plan to resolve the issue for good.

In the end, Councilor Krause decided to vote ‘no,’ and the measure failed, with only six votes in favor. President Boyle asked CAO Montgomery what came next, and he responded by saying Administration would likely push to take the money from the general reserve fund at the next board meeting. The city does have a potential white knight in this whole affair, however: at some time in the next month, a federal court will rule on ongoing litigation between the city and the Fon Du Luth Casino, and should the city win, the $12 million settlement will easily cover the debt. While CAO Montgomery made it clear they cannot count on a positive result, the entire council was likely left hoping for a swift ruling from the courts.

Next up was the authorization of bonds to pay for the Lakewalk expansion, and Councilors Fosle, Stauber, and Krause once again held the line on further spending. Councilor Fosle grumbled about wants versus needs, while Councilor Julsrud reminded the Council that over half the project was being paid for in grant money. A simple 6-3 majority passed the ordinance, and a related second ordinance was tabled.

Several resolutions were then read for the first time, and though there was no voting on the issue, there were two speakers on a trio of proposals amending the city code on the matter of electronic cigarettes. Mr. Brian Annis, a longtime smoker who had weaned himself off tobacco by using e-cigs, told of his failed past attempts to quit, and how his conversion had inspired other smokers to switch over to the healthier alternative. He’d clearly done his research, and the Councilors were swift to invite him to an agenda session, as they had not had any defenders of e-cigs at the Committee of the Whole meeting earlier that day. Ms. Jill Doberstein of the American Lung Association countered his claims by saying electronic cigarettes “normalize” smoking, and that their use is often recreational instead of being a means of quitting. She demanded consistency from the Council in its regulation of smoking products.

The Council concluded its formal business by passing two more ordinances without debate: an amendment of city fine fees (opposed only by Councilor Krause), and a zoning change (approved unanimously). In the closing comments, Councilor Larson reminded the city of Food Truck Fridays at the public library, while Councilor Krause asked someone to look into the heavy attire facilities maintenance workers are forced to wear even in the worst summer heat. Councilor Stauber asked if a biennial actuarial study of unfunded liabilities was under way, which it was, and Councilor Hartman took a moment to thank his colleagues for the policy-driven debate about the CIT fund, even though he was unhappy with the result. He admitted it was probably “very boring for the general public,” but he had an excellent point: instead of endless “theatrics,” the Council really had gone to the heart of the issue, and in government, the boring debates often are the most productive. While the nuttiness of a Duluth School Board meeting may be more interesting to those of us trying to endure 90-degree meeting chambers, the Council continues to quietly inspire confidence, and in such a climate, the minority view may even have a better chance to win out—as Councilors Stauber, Krause, and Fosle showed tonight. Whatever one thinks of their vote, that is an encouraging thought.

Gronseth’s Gambit: The School Board Will Let Duluth Vote (Meeting Notes, 8/20/13)

On Tuesday night, I joined a horde of wilting Duluthians in the Board Room. Historic Old Central High School has no air conditioning, and even though the temperature cleared ninety, the room was full of red-faced people. Many of the school board candidates and usual suspects were lurking around, and several hijacked my normal spot by setting up their own video cameras, forcing me to a sideline seat by the media. An MIA Member Cameron apparently fled to the beach, while Member Johnson celebrated the weather with a Hawaiian shirt, and the middle five people on the dais were color-coordinated in light blue shirts. The mood at the start seemed light, with Member Johnston sharing a joke with Superintendent Gronseth, but with a major debate about which levy options to send to voters on the table, the ending was certain to be different.

For once, Member Johnston did not have a beef with the previous meeting’s minutes, and the District moved on to celebrate the installations of educational gardens at a number of schools. After that, it was on to public comments, and the first four speakers were all candidates in the upcoming election. The first was the only real newcomer to Board affairs, at-large candidate Joshua Bixby, a middle-aged, well-polished man with salt-and-pepper hair who looked like he was fresh off a round at the country club. (Surprise! he lives in Congdon Park.) He asked the Board to support a voter-approved levy in order to restore trust, voiced his pleasure with the dialogue at a business committee meeting, and made the sensible suggestion that standing committee meetings be opened to the public, as Board members often have their minds made up by the general board meetings, rendering public comments nothing but a “moment of catharsis.”

Next up was Mr. Loren Martell, who sounded far more coherent than usual and celebrated the Superintendent’s recommendation that the levy appear on the ballot. He took a shot at Student Member Thibault, who was quoted in a recent News-Tribune article as saying the District should impose a levy without a vote, and grumbled about the civics lessons the Board must have taught him. Mr. Harry Welty came forward next, and in a display that can only be described as Harry Welty-ish, attempted to have a dialogue with Superintendent Gronseth involving head signals, was left confused by the Superintendent’s response, and trailed on in support of a vote on the levy. Ms. Marcia Stromgren rehashed her normal litany of complaints, and Mr. Tom Albright, a volunteer pushing for the passage of the levy, thanked the Board for its thoughtfulness.

The Board then breezed through Education and HR Committee business in record time. Sup. Gronseth gave a progress report on construction at Congdon and Myers-Wilkins Elementaries, and said he had shut down his office today after temperatures cleared ninety. Member Johnston, delivering the Education Committee report in Member Cameron’s absence, said the Committee had looked at pictures of blizzards during its meeting to try to keep cool.

When the Business Committee agenda came up, Member Johnston again broke several issues off from the rest of the agenda for separate discussion and vote. First came some funding for online programming for students who are homebound or at the alternative high school; he wanted to make sure the funding had been pre-allocated, which it had, though only as an estimate. Member Westholm pressed District staffers on the possible fuzziness of online education, and asked if there were models for the program; Assistant Sup. Crawford and Unity High School (the alternative school) Assistant Principal Adrian Norman responded by painting a picture of an interactive program tailored to fit each student’s needs that will be carefully watched in its pilot year. Satisfied, the Board approved the Virtual Schools contract and some AmeriCorps funding, 6-0. After that came the usual complaints by Member Johnston over change orders; he groused that they were voting on projects that had already been started or even completed. Member Seliga-Punyko insisted that the Board did indeed approve these projects in April, and asked if Member Johnston would have them tear up the sidewalks and playgrounds now. Member Johnston insisted that he was simply making a point that this “is not the way you do business,” and was the lone vote against the change orders.

After that, it was on to the main event of the evening: the levy plans. The School Board had three options to vote on:

1. A $300 levy imposed by the Board without a vote, which would also lock down $1.1 million in extra state aid.

2. An existing $212 state equity levy for larger districts, which could either be tabled indefinitely (effectively re-approving it), or rejected.

3. Two ballot questions in the November election, the first of which is a $600 levy that would match the current operating levy and also include (as part of the $600) the $212 equity levy, and the second of which would raise the levy another $200. The passage of the first leg would guarantee the $1.1 million in state funding, but its failure would cost Duluth the entire package, aside from the $212 equity fund (assuming it is not rejected).

The imposed levy was up first, and Member Seliga-Punyko took the stand to make a case that summed up her six years of work on the School Board. It was, effectively, an argument for representative democracy, and what she saw as the school board’s right to do whatever it thinks is best for the district, regardless of public opinion. She listed off a number of other bodies (some elected, some not) that can raise taxes without voter input, and asked why school boards are held to a different standard. “Why would you put the district in jeopardy?” she asked, shuddering at the thought of cutting $7 million in funding if the $600 levy were to fail at the ballot box. She envisioned a District in which all arts and athletics are gone, with 50-plus students in every classroom, and insisted that students came first; the issue was “not about the confidence of the voters, but being a responsible governing body.”

Student Member Thibault echoed Member Seliga-Punyko’s comments, while Member Miernicki respectfully disagreed. There was much confusion about the language of the resolution, freeing Chairman Kasper to deliver the line of the night: “we’re muddled in bureaucracy. Imagine that!” Sup. Gronseth told of his meeting with state legislators on Monday, which left him encouraged that lots of people are on the same page, and he said Duluth needs to move past its past issues and have hope and faith that the community will support it. (The words “hope” and “faith” were thrown around so often tonight that I wondered if I had perhaps accidentally wandered into an Obama rally.)

In a moment of rare agreement, Member Johnston thanked the Superintendent for his words, and offered his support for the ballot measure. He said that imposing the levy would jeopardize later motions and increases, and was responsible to students, taxpayers, and District staff over the long-term. He said it was “symbolic” that he and the Superintendent could agree on this. Chair Kasper agreed, admitting it was a big risk that he did not support lightly, but insisting that responsibility had to be given back to the taxpayers. The imposed levy failed, 5-1, with Member Seliga-Punyko the lone vote in favor.

The meeting degenerated from there, as the discussion over the equity levy swiftly became a mess; no one really knew what was going on. Members Johnston and Miernicki misinterpreted Sup. Gronseth’s intent, leading the Superintendent to hastily try to explain it all: the measure is not board-authorized, but state-authorized, and tabling it would accept the funds, not delay a decision. Member Johnston said that accepting this funding would “confuse” voters, make them think the Board was raising taxes, and “was a sure way not to get this money.” Member Seliga-Punyko lashed out, claiming this was “an excuse” to vote ‘no’ designed by people who are trying to bring down the levy,” “including a Board member.” Member Johnston asked that Chair Kasper reprimand her for impugning him, which he did. Member Seliga-Punyko also asked why this was even up for a vote, which Sup. Groseth answered by saying that it was the only way to have a debate about it. The normally quiet Member Wasson did her best to cut through the confusion and get the simple message: this is not a tax increase, and merely a stopgap to guarantee a few dollars if the levy does indeed fail at the ballot box. Over Member Johnston’s “begging,” the Board approved the equity levy, 5-1.

Angered, Member Johnston voiced his displeasure when the Board opened discussion on the 2-part ballot measure levy. He said the $212 equity levy “does nothing for us,” and thought the confusion of a two-part ballot question would only be “another nail in the coffin” for a measure that faces an uphill battle. He tried to peel off the second question so as not to “muddy the water,” but the rest of the Board voted against him. Member Wasson asked Business Services Director Bill Hansen if the explicit line “this is not a tax increase” could be put on the $600 levy, but was disappointed to hear a “no” in response. Member Johnston continued his parliamentary wrangling by announcing his support for the $600 levy despite the fact that he would abstain from the vote to put it on the ballot due to his opposition to the additional $200 question. After the meeting, Member Seliga-Punyko could be overheard doubting his good faith. The measure passed, 5-0.

Next up was a state-funded bond, and although the bond before the Board had nothing to do with the District’s credit rating, Member Johnston rolled out a series of quotes from Moody’s Analytics’ recent decision to downgrade the District to perhaps the lowest rating in the state. His point really was a good one: the bond downgrade is a real issue, and does indeed show that some of Member Johnston’s concerns over the years were well-founded. But when Sup. Gronseth reiterated that the District’s rating had nothing to do with the bond in question, Member Johnston yet again had to get in the last word. There is no such thing as a time and a place for Member Johnston: he must make his own righteousness clear at every turn, an act that is, frankly, the epitome of “muddying the water.” Nothing is made clearer by interjecting on every single point and going off on tangents, no matter how much they may prove him right; even though he usually adds the necessary caveats, discourses such as this one are not the mark of someone genuinely concerned about the District. They are the mark of a man trying to score political points for his platform so that he can tell people he was right. He claims to support the levy, but will claim vindication if it fails; he insists the public is well-informed about Board matters and will see through the confusion, but no one did more to advance the confusion than he did.

By the end of the meeting, the heat of the discussion and the room was driving everyone nuts. When Member Johnston belabored one particular point, a red-faced Member Miernicki threw his head skyward in exasperation. Chair Kasper twice announced there were no more lights lit and moved to a vote when other Members’ lights were quite obviously on; upon being shot down, Member Wasson shook her head and sighed as if to say “to hell with it.” Chair Kasper’s request that Member Johnston clarify a statement led to an obstinate “I said what I said” from Member Johnston. Member Seliga-Punyko’s mumblings were audible from my seat in the audience. Once the Board moved on to less contentious issues involving election judges and such, Member Miernicki began to second measures before they had been read in their entirety. Chair Kasper told the Board he has “four months and nine days” until his term is up, “not that he’s counting.”

In spite of the dysfunction, the winner of the meeting was Sup. Gronseth, who kept his composure as all of his proposals passed. We will have to wait until November to learn how real that victory is. He avoided the easy way out—Member Seliga-Punyko’s path—and has staked his legacy on the $600 levy. If it passes, the District is in decent shape, and he is the man who moved Duluth past the Red Plan rancor and into a new era in which things might actually get done. (The $200 extra levy is a cherry on top, and while I will support it, I don’t have a lot of faith in it.) If it fails, the losses will be catastrophic, and no one’s hands will be clean. Not Member Seliga-Punyko’s: even though she tried to avoid this path, her support of the Board’s past heavy-handed tactics will have come home to roost. Not Member Johnston’s: while he may try to say “I told you so,” his behavior has always prioritized his own purity over any sincere care over the direction of the District, and his endless parliamentary nitpicking did nothing but cloud matters further. And certainly not Sup. Gronseth’s, whose chumminess and leap of faith will appear naïve.

I’m on my knees in prayer already.

Councilor Fosle Takes a Stand: Duluth City Council Notes, 8/12/13

After a month-long recess, the Duluth City Council re-convened on Monday night in front of an unusually small crowd in the council chamber. There wasn’t a single citizen speaker, and the agenda was on the light side, but the Council still found plenty to wrangle about.

The meeting opened with city Chief Administrative Officer David Montgomery giving the council two updates. The first regarded repairs planned for the perennially out-of-service Minnesota Slip Bridge, a pedestrian walkway that has become such a financial drain that Mayor Ness recently proposed getting rid of the thing altogether as part of a larger redevelopment of the waterfront area. CAO Montgomery then gave several updates on FEMA funding for damage from the 2012 flood; over half of the funds have now been approved, though some were rejected, a small sum is going through an appeals process, and a large chunk—some $15 million in stream restoration—is still pending approval. Satisfied, the Council proceeded to approve the consent agenda unanimously, and CAO Montgomery asked them to return a resolution on street improvement to Administration.

Next up was a resolution for the purchase of three street maintenance trucks, and Councilor Fosle, who was in a combative mood all night long, voiced his displeasure. “Maybe if I keep saying this, someone will listen,” he said, griping that he had been a mechanic for thirty years and that the maintenance costs and supposed wear-and-tear on the existing city vehicles were out of hand. He figured the city either “asked for lemon vehicles” or that the Facilities Department is “trying to make money for itself.”

Council Stauber said he “appreciated Councilor Fosle’s expertise,” and also announced he would not support the measure. CAO Montgomery said the city had run comparisons to other shops and found the repair rates comparable; Councilor Krause pressed him on these numbers, but appeared to be satisfied by the response. Councilors Gardner, Hartman, and Krug expressed support and emphasized how well-informed they were, with Krug detailing her visit to the garage last year to inspect the city fleet. Councilor Fosle, while unconvinced, did agree with the other Councilors over the need to address the billing system. The resolution passed, 7-2, with Councilors Fosle and Stauber in opposition.

The next two topics of debate both involved the issuance of temporary liquor licenses to local establishments. The first was for the recently reopened Hacienda del Sol restaurant, which owes the city over $33,000 in back taxes and utility bills; Councilor Julsrud, while professing her love for Hacienda, noted that “that’s a lot of burritos,” and asked CAO Montgomery about its financial stability. CAO Montgomery lacked exact numbers but said the restaurant had been meeting deadlines for some time, and he also reassured Councilor Krause that a “tenacious” new employee was on hand to flag potentially troublesome businesses and ensure this wouldn’t happen again. Councilor Gardner pointed out that a liquor license would make it easier for Hacienda to pay back its tab, and Councilor Julsrud recommended further short extensions of the license so as to hold the restaurant accountable. The measure passed, 9-0.

The second license concerned the Flame Nightclub, which was seeking to expand its operation, though its owner had admitted to Council President Boyle that recent troubles with crime around the establishment would likely force the delay in the expansion. The police had compared the crime numbers at the Flame to other local bars at a meeting during the previous week, but Councilors Gardner, Hartman, and Julsrud did not think it was a particularly good comparison, as the Flame is a fairly unique establishment. Given the confusion, Councilors Krause and Larson said they hoped the resolution would be tabled, but Counsel advised the Council to go ahead and vote. Much grumbling and confusion followed; Councilors Gardner and Hartman suggested they approve the license anyway and give the Flame a test run to see if it had cleaned up its act, while Councilors Krug, Larson, and Krause thought it best to respect the unanimous ruling of an advisory council against the permit until the situation improved, which they were confident it would. Counsel assured Councilor Fosle that it would be easy for the Flame to re-apply, and the Councilors then voted down the license 7-2, with the votes in support coming from Councilors Gardner and Hartman.

The last contentious issue on the agenda involved a resolution supporting an assessment of the main Duluth Public Library facility. Councilor Larson led the charge, noting heavy usage and major inefficiencies in the 33-year-old building, and CAO Montgomery said the existing building is at a “tipping point” due to its serious energy inefficiencies and the evolution in library usage over the years. Councilor Krause asked where the money would come from; while CAO Montgomery’s answer was vague, Councilor Larson assured him funds had already been allocated from the 2011 Capital Fund.

Councilor Fosle was not a fan of the resolution. He noted that there are many buildings older than this one—a charge that Councilor Hartman called “unfair to say out loud” given the differences among the buildings in question—and wondered why the Council should be thinking about replacing a functional building when community centers across the city were still closed. He went on to rail against how the Council was “spending more money every time we turn around,” raising taxes and fees; “this kind of funding has to stop,” he insisted.

Several people in the room responded to his outburst. Councilor Julsrud said that the library is, effectively, a community center, and CAO Montgomery was at pains to counter Councilor Fosle’s portrayal of the city’s tax record. Councilor Gardner said the community centers and the library were not under the same umbrella; this led Councilor to Fosle to ask whether a referendum passed in the 2011 election covered both parks and libraries. CAO Montgomery answered that it only provided money for parks; his response, while technically correct, failed to note that the general fund savings from the referendum’s passage were explicitly allocated for the library. (Full disclosure: I am currently employed in a temporary position by the Duluth Public Library.) He also explained to Councilor Fosle that there was no good way to tell how many library users were Duluth residents.

Councilor Krause, in an effort to hold the middle ground, acknowledged Councilor Fosle’s worries about the community centers, and noted that their usage, when trails and youth sports are taken into account, could easily exceed that of the library. However, given that the funding for the assessment had already been budgeted, he announced his support for the resolution. It passed, 8-1, leaving Councilor Fosle to grumble during the closing remarks about how such resolutions seem to snowball far beyond their initial intent. It concluded a long night of calls for fiscal restraint from Councilor Fosle; while that voice needs to be heard, his complaints often appeared haphazard and not altogether coherent. Until he can pull together his critiques into a well-honed message, he will be unlikely to generate more than a few polite nods from the Councilors who are closest to him in their political views. Otherwise, he comes across as a loose cannon, and it requires serious effort to filter his most cogent points out from all the other noise.

What Is Duluth’s Future?

This is going to be a sprawling post, and I envision it as the start of a series on Duluth, Minnesota, my hometown, that builds on the fairly narrow focus of my posts on city council and school board meetings.  For those of you who have never been there, it is a city of 85,000 on the tip of Lake Superior, and the world’s largest freshwater port; and no, it is not a suburb of Minneapolis. (When I was in the college on the East Coast and told my classmates I was from Duluth, Minnesota, the inevitable next question was, “is that near Minneapolis?” They didn’t know how to respond when the answer was “no.” There were also the girls who once asked me if Minnesota was near Maine. And the one who didn’t believe that ice fishing was a real thing. But I digress.)

At any rate, a few days ago, the New York Times ran a piece by Robert Putnam, a Harvard scholar famous for his book Bowling Alone, which explores the decline of communal bonds in the United States. His work is some of the most fascinating stuff on modern American culture, though as with all scholarly work, there are intelligent critiques and rebuttals and endless back-and-forth nitpicking. While nuance is always necessary, I do worry about fraying social fabric and the increasing isolation in modern America, and perhaps more importantly, the pathologies that afflict an increasingly stratified society, from broken families to drug abuse to cycles of poverty. Without going straight into causes, solutions, and ultimate implications, it is clear there is a problem here. The ability of a city to cope with or adapt to these issues will likely determine its fate.

This particular article was more focused, however; it told the story of Port Clinton, Putnam’s Ohio hometown along the shores of Lake Erie. Like much of Middle America, Port Clinton has not fared particularly well economically in recent decades; its manufacturing base has collapsed, and though its lakeside location has kept some money in the town, it is now very divided, and not the foundation for the American Dream Putnam claims it was when he grew up there in the 1950s.

There is a shoutout to Duluth near the end of the piece, and the parallels are not hard to see. (The results of the Duluth surveys taken for Putnam’s project, while they do not mention many of the things discussed in the NYT piece, are here.) Duluth is much larger than Port Clinton, but for a while, it looked like it was going down the tubes when it lost its U.S. Steel mill and shed perhaps 30,000 residents toward the end of the 20th century. Like Port Clinton, Duluth has weathered the storm somewhat thanks to tourism dollars, and it has been fairly stable for two decades now. For all its troubles, Duluth really hasn’t fallen off the cliff in the way Putnam seems to think Port Clinton has.

If Duluth doesn’t fit so smoothly into the narrative of Midwestern industrial decline, we have to ask what sort of story we can tell about Duluth. In addition to the tourism dollars, I’d attribute Duluth’s resilience to two factors:

1. Due to its size, it remains a regional hub in a way that most small towns in America aren’t. Duluth may not have grown since it stopped shedding people in the early 90s, but it also isn’t shrinking, while most of the rest of the region is; its quasi-suburban areas, Hermantown and several unincorporated townships, have actually seen some growth. While Duluth may not have the opportunities Minneapolis does, it does have some allure when compared to small northern Minnesota towns. It has two 4-year universities, remains a busy transportation hub, and many regional services that cannot be outsourced to a metropolis or Malaysia (health care, certain government agencies, etc.) are based here.

2. Old money. At the start of the twentieth century, Duluth was a millionaires’ playground, and though not all of the grand old houses on the east side are in the best of shape these days, a chunk of the money is still here, doled out from trusts, foundations, and donations from heirs. For example, the revitalization along the waterfront likely would not have been possible without the efforts of the late pizza roll magnate Jeno Paulucci, whose restaurants anchor the Canal Park area. Putnam’s piece mentions the scholarships set up for many local students; Duluth has a bevy of such awards, and I received one that kept me debt-free through college.

(In a rebuttal to the Putnam piece, Front Porch Republic’s Jeffrey Polet points out that such scholarships may simply funnel graduates out of town, never to return. He may have a point; I am sure some of the recipients I graduated with, happily farmed out to elite colleges, will never be back. In my case, however, the strength of the Community Foundation and my sense of obligation to that history were among the many things that kept me grounded here.)

Duluth does very well in the indicators of social cohesion, which bodes well for the city, though some of Putnam’s later work shows that more homogenous communities tend to have much stronger social fabrics (a fact that so deeply troubled Putnam that he took years to release his data). Duluth, being 92% white and with strong northern European ties, obviously fits the bill. Moreover, it is a fairly segregated city (and not just in terms of race, though most minorities are concentrated in the city center). When explaining Duluth to outsiders, I’ve often described it as two separate cities: a combination college town/comfortable suburb on the east side, and a struggling rust belt city in the west. This is overly broad, of course, and perhaps an uncharitable portrait from a dyed-in-the-wool east-sider. The west side’s civic pride remains strong, and lower-income housing has been creeping eastward somewhat. But a simple look at the public high schools tells the story: three central and west Duluth high schools have folded into one since 1980, and East High remains much larger than that single western high school, Denfeld. (The East attendance area grew somewhat with the closure of Duluth Central a few years ago, but not drastically, and the school-aged population—a good indicator of how desirable an area is for families moving in—is much more dense on the east side.) Duluth East is the home of the “cake-eaters” of the north—it is the wealthy school that has long overshadowed Denfeld in academic and athletic prowess, even though Denfeld retains a very loyal following; perhaps even greater than East, since west-siders are far more likely to stay put while the East kids head off to supposedly greener pastures.

The divide is also made fairly clear by the quality of life and perceived political influence statistics in the Putnam study (see p. 49-54), though the west side does have some real strengths in those numbers. (This write-up also doesn’t mention where the dividing line is, which would be interesting to know.) This invites several questions:

-Duluth sprawls along 27 miles of lakeshore and riverfront, and there is a ridge along the length of the city that makes construction impractical in many places. How much does geography make Duluth’s divisions inevitable? The flip side of these divisions are some very strong local neighborhood identities, and I think these can be very good things. Are the divisions bad in and of themselves? Putnam certainly thinks so, and though I certainly understand that hyper-localism has its downsides, and can lead to discrimination, I’m not entirely convinced—in part for the reasons Polet touches on, though he doesn’t do a very thorough job in that post.

-What role do suburbs (ie. Hermantown) and new construction in Duluth Heights (away from the lakeshore and “over the hill”) play in Duluth’s development?

-Whither Superior? The Wisconsin city across the bridge is sometimes derided as Duluth’s armpit, but it still has a substantial a population and is an important part of the metro area. (And where else would we Duluthians go to buy our liquor on Sundays?) In the parts included in the Putnam study, it scores noticeably worse than Duluth in some respects. How does its fate affect Duluth’s?

-One effort to revitalize Duluth seems to evoke a hipster vibe. The attempt to attract “creative people” to revive the economy is mocked at times, but there is a certain logic here: in many cities (Manhattan, parts of Washington DC, San Francisco, and on and on), urban renewal (or gentrification, depending on how one looks at it) starts with artsy people moving into cheap housing, making the neighborhoods “interesting,” and in turn attracting wealthier wannabe urbanites who gradually displace the poorer people. Given Duluth’s universities, natural beauty, and decent arts scene for a city of its size, it seems to have potential for the hipster crowd. (Witness the dramatic rise in microbreweries and the expanding bike paths.) Mayor Don Ness, who is in many ways emblematic of this movement, certainly seems to be pushing it, as do several city councilors.

But this brings up some necessary questions: is this desirable development, and does the fact that it often just ignores or pushes poor and working-class people elsewhere trouble anyone? This model seems to work in major urban areas, but how well does it apply to a much smaller city? At first glance, a lot of this appeals to me—while I am probably a bit too clean-cut, conservative in temperament, and boring in my musical tastes to be a proper hipster, I enjoy culinary variety and good beer and a vibrant arts scene, and I’d much rather have more localized development than further urban sprawl. But I can still hear City Councilor Garry Krause’s words echoing in my mind: is our obsession with the new and interesting coming at the expense of the mundane, and the people who have called this city home for generations?

While Mayor Ness is a very popular and personable man who won re-election unopposed in 2011, in his initial election in 2007, he won the east side and lost the west side of the city. At the time of that election, I remember a high school teacher noting the unusual fact that Ness, by far the more liberal candidate, did better with the wealthier Duluthians, which seems to counter our normal political narratives. Looking at it from this perspective, it makes a lot more sense now.

-Duluth also includes many newcomers, and if certain critics are to be believed, it attracts a number of poorer people who look to take advantage of its relatively strong social safety nets. Councilor Jay Fosle had a complaint (not well-explained to the broader public) a few meetings ago about U-Haul rental patterns in Duluth; back in that 2007 mayoral election, Ness’s opponent, Charlie Bell, made some sort of remark about people from places like Chicago showing up and causing problems. Can someone give this critique some coherence or empirical backing, or is it just shoddy identity politics? And if it is true, what do we make of it?

This post is getting out of control, so I’ll cut myself off here. I’m throwing this open for discussion, in large part because I don’t know the answers. Urban planning interests me as a field, but I’ve never really pursued it because, eternal critic that I am, I have yet to latch on to any sort of coherent vision for how to revitalize a city. Duluth has considerable potential with its location, strong civic engagement, and unique culture; this city has a soul, and a lot of people probably don’t realize how unique that is. But where do we go from here?

Art in the Schools: Duluth School Board Notes, 7/16/13

The Duluth School Board packed into the board room on Tuesday evening, joined by a modest but quiet crowd. With a heat wave sweeping Duluth (to the extent that any heat wave ever sweeps through Duluth), only Member Miernicki wore a suit and tie; Member Kasper apologized for the Board’s casual attire during a photo-op with a Duluth East student who had done well at the National History Day competition. One of the Student Members was absent, as was Superintendent Bill Gronseth, whose place on the dais was taken by Assistant Superintendent Ed Crawford. But Member Art Johnston was on hand, guaranteeing the audience a few fireworks as the night went on.

Once again, the fun began during the approval of the minutes from the previous meeting. Member Johnston complained his motion to offer a completely different budget was not in the minutes, which was a violation of district bylaws. This time around, the other members fired back. Member Seliga-Punyko said that, as had been explained to Member Johnston “several dozen times” over the past few years, a motion that does not receive a second simply dies, and does not need to be recorded. She cited Robert’s Rules of Order and the opinion of district legal counsel, and finished her salvo by noting that a Board member was wearing illegal campaign material.

Member Johnston, who had an “Art Johnston for School Board” shirt peeking out from beneath his Hawaiian shirt, invited Member Seliga-Punyko to call in the police to arrest him, as she had threatened to do several years earlier; it “would be exciting,” he told the crowd. He reiterated his point about the bylaws, to which Member Kasper attempted to reply by citing the opinion of Superintendent Gronseth, Business Services Director Bill Hansen, and legal counsel. Member Johnston huffed that these people were “not parliamentarians,” but voted to approve the minutes anyway.

During the time for public comments, Member Miernicki stepped down off the dais and addressed the Board as a community member in order to thank the late County Commissioner Steve O’Neil for his service to Duluth schools. O’Neil, who passed away on Monday after a battle with cancer, was a passionate community activist who had done tireless work to help Duluth students who lacked basic needs. Ms. Rosie Loeffler-Kemp, a candidate in the upcoming election, thanked the school board for its community input meetings on school planning issues, and Mr. Dick Haney, a former teacher and physical wellness advocate, urged the Board to approve a trail easement across the campus of the shuttered Duluth Central High School.

The first topic to invite much debate was the district’s Continuous Improvement Plan, a long-range vision to improve district-wide academic achievement, school safety, and efficiency. Member Seliga-Punyko emphasized the importance of elementary school specialists and the arts in the Plan, which led Member Kasper to crack that he was glad she supported “Art” in the schools, giving Member Johnston a good laugh. For his part, Member Johnston said he supported the plan, though he had three concerns: he wanted to know why the Plan was on the District website and in the media before it had been passed; he wanted to add goals to reverse enrollment declines; and he wanted a plan to restore the balance of the district’s depleted general fund. Member Miernicki answered the first point to Member Johnston’s satisfaction, arguing that media coverage and web presence was necessary to bring in the community input the District desired. Member Wasson echoed this theme and also pushed back on the enrollment goal, noting that most every school district in Minnesota is shedding students. In a cautionary note semi-subtly directed at Member Johnston, she also said that “negativity” around the Board would be a problem in implementing a plan they all agreed was necessary. Member Johnston earnestly explained that he was not being negative by voicing a few concerns, and the Plan passed unanimously.

During the Human Resources Committee’s resolutions, a motion came up to rescind the layoff of a single teacher. Member Johnston, rather understandably confused by the wording of the resolution, thought it was an effort to cut the position, and Member Kasper hurriedly tried to correct him. HR Director Tim Sworsky clarified the wording, and Member Johnston grumbled about its confusing nature before voting to support the re-hiring.

Next up was the Business Committee report, which included the easement to create a trail across the old Central property. While all were supportive of the idea (aside from some mild worry about wetlands from Member Johnston that he figured could be worked out), Member Wasson motioned to table the vote until they could have more feedback from Mr. Kerry Leider of Facilities Management. The Board Members then spent a while agreeing with each other in their wishes for clarifications on the unsold site’s zoning, and Mr. Leider said he believed their concerns would be met. Member Johnston had some concern that delays would hinder any construction on the project this year, though he also admitted he wasn’t sure any real progress this year was realistic anyway. The Board tabled the measure 6-0, with Member Johnston abstaining.

When it came time to approve the entire Business Committee Report, Member Johnston singled out a series of measures for separate votes, all of which he supported, leading them to pass unanimously. This left him free to vote against the remainder of the report, which included several change orders (which he had criticized at the June meeting), though he did not belabor his point this time around. His maneuvering allowed him to hold his line on facilities spending while also voting to support various fundraisers, investments, insurance policies, and a community collaborative project. The Members then wrapped up a meeting that, aside from the spat over the minutes at the start, appeared more constructive than the previous month’s, albeit with a less controversial agenda on their plate.

Tuesday was also the filing deadline for this fall’s School Board elections, which will feature a lot of familiar faces. While Members Cameron, Kasper, and Wasson are headed for retirement, former Members Nancy Nilsen and Harry Welty are throwing their names back into the fray for the two open at-large seats. Member Johnston will pursue re-election, though he faces two challengers in his western Duluth district. Two of Member Johnston’s most loyal lieutenants, Ms. Marcia Stromgren and Mr. Loren Martell (both surprisingly absent from Tuesday’s meeting), are back on the ballot after failed past runs. (Mr. Welty is also a member of the old anti-Red Plan crowd, though I consider him a more complex figure than single-issue candidates like Ms. Stromgren and Mr. Martell.) With the District’s operating levy also on the ballot, the election should prove an interesting referendum on the work of the past few Boards.

Raising the Staff: Duluth City Council Notes, 7/15/13

The Duluth City Council was in a chipper mood on Monday night, and not without good reason. Mayor Don Ness informed the Council that the city had won a Local Government of the Year award within the state of Minnesota, and Councilor Krug was “just as happy as can be” to announce that the city’s anti-synthetic drug ordinance is now officially on the books. It went into effect last Thursday, a restraining order against the city sought by synthetic drug seller Jim Carlson was rejected by a judge earlier in the day, and police report that service calls are already down by one third in the area surrounding Mr. Carlson’s business. (No one bothered to mention that one of these calls was related to an assault upon Mr. Carlson himself, at the hands of a deranged customer.)

The city council chamber was quite full for the meeting; though it only lasted an hour and did not involve a single vote that was not unanimous, many speakers made their way to the podium. Councilors Krause and Larson were missing in action, and most of the Council was in a summery mood and wore white, though Councilor Fosle, as always, wore black.

The first group of speakers to come forward took a stand on the issue of a Native American eagle staff that was planted in front of City Hall in 2011. The city recently claimed it was an unauthorized memorial that did not belong on city property, and ordered its removal. The city’s Native American community was none too fond of this decision. Ricky DeFoe, the Chair of the Duluth Indigenous Commission, railed against the “white hegemony” that was “fatal to itself, morally and spiritually,” and to the “world as a whole.” He explained that the eagle staff is a “spatial-iconic metaphor” that connected the people to land, space, and place, and juxtaposed it against other city monuments that celebrate European figures, such as the Angel of Hope and a statue of Leif Erickson, a Viking explorer who never came within a thousand miles of Duluth whom Duluth likes to celebrate anyway. The removal of the staff, he continued, amounted to “systemic racism,” and he claimed that his attempts to get a hearing in front of the council have been ignored.

Three speakers followed Mr. DeFoe and expressed similar sentiments. Mr. Gabriel Peltier greeted the council in Anishinaabe, framed the staff as a civil rights issue, and requested a conversation in good faith. Both he and the next speaker, Ms. Rebecca Domagala of the Human Rights Commission, likened the staff to a flag in its symbolic power. Mr. Allen Richardson, the final speaker, claimed the city “failed to use basic listening skills” and pointed out that Duluth was founded on land that, according to U.S. law at the time, should have been preserved as a reservation. Mr. Richardson closed by blasting the “silence of indifference” to Native American affairs common in the city.

As there was no official business involving the eagle staff before the Council, the Councilors could not respond until the end of the meeting, when most of the Native Americans and their supporters had already left the hall. Councilor Gardner, though at pains to make it clear she wanted to find a constructive resolution to the issue, did voice a pair of concerns. First, she disputed the notion that the city had ignored the Indigenous Commission, and said neither she nor Councilor Hartman had been approached for a meeting while serving as Council President. Second, while she admitted the staff was more subtle than a simple religious sign, she also reminded her colleagues of an explosive controversy surrounding the presence of a Ten Commandments monument on city property some years back. The Council, she suggested, would be wise to hold its previous line on issues of church-state separation. Councilors Julsrud and Boyle expressed hope for eventually “finding peace” on the issue, and Councilor Fosle, while not entirely clear in his comments, seemed to be disappointed the Native American groups had not been content with the offer to place the staff on Spirit Mountain, a site of religious significance to the Ojibwe in Duluth.

Several other speakers came forward before the meeting continued. There was a second plea in as many meetings to enforce the city’s fireworks ordinance; one man complained about zoning and planning issues around an office tower planned for downtown Duluth; a man expressed worry about a derelict property alongside his house; and a representative of the Hawk Ridge Bird Observatory clarified his group’s stance on possible development beneath the bird-watching area on the city’s east side.

After that, the Council cruised through most of its official agenda, the most significant action taken being the return of the long-tabled Pastoret Terrace project to the administration by a unanimous vote. Councilor Gardner explained that, after a meeting with the developer, the backers of the project decided not to pursue city-approved grant funding, but will instead move forward seeking other sources of funding for mixed-income and low-income housing at the site of the old Kozy Bar.

One last issue brought forth significant public input, as four citizens spoke on a pair of opposing resolutions; one which would make lower Piedmont Avenue an official truck route to receive state funding, and one to ban trucks from the same roadway. The speakers, all of whom live along Piedmont Avenue, begged the council to get rid of the trucks, which have drastically lowered the quality of life along that street as they go through countless shift points on their way up toward the mall. The trucks have “decimated” the neighborhood, with as many as sixty an hour climbing up what was supposed to be a residential street, causing excessive noise and vibrating one man’s deck away from his house. The Councilors rallied to their cause, with Councilor Fosle congratulating whoever had written the resolution for making exceptions for oversized windmill trucks that cannot use an alternate route. The truck ban passed, 7-0, rendering the second resolution academic.

In the closing comments unrelated to the eagle staff and synthetic drugs, the Councilors focused primarily on a street repair timeline. Council President Boyle introduced the timeline and suggested another open session for input was in order, while Councilor Fosle made it clear he opposed the process. Councilor Stauber had other issues with the timeline, which he and Council President Boyle appeared to resolve after a brief back-and-forth. Councilor Fosle expressed some incredulity over taxes levied on the sale of old bricks torn out of the recently repaved Superior Street, and Mayor Ness promised to look into the matter. Councilor Hartman wrapped things up by reminding the public that the filing deadline for the 2013 city elections is tomorrow, and the Council then adjourned to its three-week summer recess.
